Compensation
As per the 2020 Florida Statutes Chapter 768.21, surviving family members may be entitled, but not limited to, the following compensation:
- Medical and funeral expenses
- Mental and emotional pain and suffering
- Loss of companionship, protection, and guidance
- Loss of future wages and benefits
- Punitive damages
- Loss of anticipated earnings
Like every law, a statute of limitations is in place that limits the time the heirs can file a lawsuit for wrongful death or else it will be barred. Most times, a lawsuit for wrongful death can only be filed within three years, starting from the day the person died. While for some, the time limit depends on whom and what caused the wrongful death. The court may refuse to hear your case if the statute of limitations has already elapsed.
